Municipal Licensing and Registration with CTCMPAO

Municipalities (cities and towns) can require practitioners of traditional Chinese medicine and acupuncture to obtain a business licence to practise within their municipality. Municipalities can regulate certain activities of the licensed person/operator, but do not concern themselves with professional standards of practice.
It is the duty of the Minister of Health and Long-Term Care to ensure that the health professions are regulated and coordinated in the interest of public safety, that appropriate standards of practice are developed and maintained. Only the College of Traditional Chinese Medicine Practitioners and Acupuncturists of Ontario, being one of the health regulatory Colleges under the Regulated Health Professions Act, 1991, can regulate the practice of traditional Chinese medicine and acupuncture. The College is authorized to set its own registration and professional conduct rules. The College’s rules are completely independent from municipal licensing. As such, holding a municipal licence will not in any way qualify a person for registration with the College. On proclamation of the Traditional Chinese Medicine Act, 2006, no one will be able to hold themselves out as a traditional Chinese medicine practitioner or as an acupuncturist or perform a controlled act while engaging in the practice of traditional Chinese medicine. He/she can do so only when he/she is registered with the College. Even individuals holding a municipal licence will have to stop all such activities once our Act is proclaimed unless they are also registered with the College.
市政府營業執照和安省中醫師及針灸師管理局註冊

各個市政府可以要求在其城市範圍內執業的中醫及針灸業者領取營業執照。市政府可以監管持牌人/經營者某些活動，但不會規管專業的執業標準。
安省衛生廳長的職責是確保安省各法定醫療專業的規管和協調，以維護公衆安全利益為宗旨，促使各醫療專業制訂及維持執業標準。安省中醫師及針灸師管理局(CTCMPAO)是根據〈法定醫療護理專業法，1991〉(Regulated Health Professions Act, 1991)成立的醫療專業規管機構之一，亦是唯一能夠規管安省中醫師及針灸師的機構。管理局是被安省政府受權制定自己的註冊以及職業操守條例。管理局的規則是完全獨立於市政府的營業執照。因此，持有營業執照的中醫及針灸業者並不代表有資格取得CTCMPAO註冊。當〈中醫法，2006〉(Traditional Chinese Medicine Act, 2006)完全生效時， 除了CTCMPAO註冊會員外， 任何人士都絕不能自稱為中醫師及針灸師，亦不能執業中醫及其『受控制行爲』(controlled act， 包括針灸治療和診斷治療) 。擁有市政府營業執照的人仕在〈中醫法，2006〉完全生效時，除非已跟CTCMPAO註冊， 否則也必須停止執業。
