The College of Traditional Chinese Medicine Practitioners and Acupuncturists of Ontario ("the College") is established under the Regulated Health Professions Act, 1991 and the Traditional Chinese Medicine Act, 2006 (the “Act”) to regulate traditional Chinese medicine practitioners and acupuncturists in the public interest. The College works in consultation with the Minister of Health and Long-Term Care, Ontario, to ensure the public has access to safe, competent and ethical services from qualified traditional Chinese medicine (“TCM”) professionals. The Act provides that only individuals registered with the College can hold themselves out as a person who is qualified to practice in Ontario as a traditional Chinese medicine practitioner or acupuncturist.
The acts of performing acupuncture and communicating a traditional Chinese medicine diagnosis are controlled acts pursuant to the Regulated Health Professions Act. Only members of the College can communicate a traditional Chinese medicine diagnosis. Only members of the College and certain other Colleges as specified in the Regulated Health Professions Act, are permitted to perform acupuncture. As part of its mandate to protect the public, the College investigates unauthorized practitioners.
On or about July 29, 2015 The College was advised by Public Health Ottawa that it had issued an Order in respect of the New Acupuncture Clinic operated by Mr. Alexander Tran and located at 1340 Wellington St., Ottawa.
The order named Alexander Tran and Phillip Tran (Member No. 2773).
The College has since been advised by Public Health Ottawa that it has rescinded its order.
Mr. Alexander Tran is not a registered member of the College.
On June 5, 2015 the College commenced an Application pursuant to s. 87 of the Regulated Health Professions Act, S.O. 1991, c. 18 to obtain an injunction to stop Mr. Tran from practicing traditional Chinese medicine or acupuncture. The Application is to be heard in Ottawa on August 11, 2015.
